The Price I Paid for Malaysian 'Justice'

Media: Wall Street Journal

Date: 01 February 2010

Nearly 12 years ago, I was languishing in a local hospital as a prisoner of conscience. This loss of freedom was due solely to my long-standing personal and professional association with Anwar Ibrahim, then Deputy Prime Minister and Finance Minister of Malaysia. We were falsely implicated in a fabricated case of having committed a mutual act of sodomy.

Such an internment, when driven by ulterior motives, brings a brutal deprivation upon the victim. It acts like a double-edged sword. While one's freedom of movement is taken away by tormentors, one's conscience suffocates in a dungeon. A poignant grief sets in once there is awareness that both the body and the conscience have fallen victim to the act of tyranny. That is what distinguishes incarceration out of an actual crime from that emanating from the acts of those who prosecute and persecute innocent others. The tormented memory never fades.

My detention by the Malaysian Special Branch taught me how it feels to be forcibly separated from one's wife and children. How it feels to be searched and seized, disallowed to make phone calls, handcuffed, blindfolded, stripped naked, driven in an animal cage, shaven bald, endlessly interrogated, humiliated, drugged, deprived of sleep, physically abused. What it's like to be threatened, blackmailed, hectored by police lawyers, brutalized to make a totally false confession, hospitalized for a consequent heart ailment, and treated as a psychiatric patient with symptoms of Stockholm syndrome. Barely surviving on a meager diet of rancid rice and chicken along with 12 medicines a day, I spent nearly 126 days handcuffed round the clock to my hospital bed, under the watchful eyes of the prison guards.

These tragic events completely ruined me and my family. The financial, physical, psychological and social implications of this calamity reverberate even more than a decade after the horrific occurrence. Words fail to describe what my family and I have quietly endured for the last 10 years. In spite of that, our faith in the ultimate victory of justice and truth has not wavered.

For the last 12 years, I have sought nothing but justice. I have repeatedly approached the Malaysian judicial system—the High Court, the Court of Appeals and the Federal Court—in the hope that justice would be duly provided to me. Unfortunately, my latest request for a review at the Federal Court was dismissed. Why does the judicial system shudder at the prospect of hearing my demand for justice? Why am I denied my day in court?

I am innocent. I am innocent of any and all spurious charges brought against me. I committed no crime for which I was tortured and unjustly imprisoned. I want the Malaysian judicial system to wake up to the fact that gross injustice was committed against me. I want them to realize that the injustice is perpetuated the more I continue to be denied my day in the court. My innocence inspires me to persist and persevere in the path of justice, as it is one of the fundamental human rights enshrined in the Constitution of Malaysia. The judicial system in Malaysia must rise to the call of duty and serve justice without any further delay.

Rosmah Women'c Champion?

Malaysian Mirror online news portal reported “Rosmah Mansor is ready to carry the role of the women’s champion to fight for the rights of women and children across the nation. She will not hesitate to lend a helping hand in ensuring the welfare of the women and children are well taken care of, she told reporters here Tuesday.” Feel funny with this news reports. If she care for women and kids then at the first place she must ensure justice delivered to Altantuya and her un-born baby. Do Rosmah dare to ensure the justice delivered in her murder case?

2nd Anniversary - HINDRAF

25 Nov will be remembered forever. Even though two years passed but the date was very fresh in every Indians mind. It was the day where Indians went to street to protest their unhappiness towards umno discriminations. While the original leaders of Hindraf is not together any more but their message to Indians to stand firm for our rights still prevail. Valga Hindraf.

Shame on you Kohilan Piilai

Shame very very shame Kohilan. You fail on your duty as human beings. You have defended the violations of human rights in Sri Lanka. Supposed you should stand firm to knock on mahindra rajapaksa head for his violations on human rights and genocide of innocent Tamilians but you failed. You think you will get Dato ship by defending the war criminals, then you are wrong. Sri Lanka genocide on Tamilians is not Sri Lanka internal matters. Genocide is international issue. Don't bullshit. Shame on you Kohilan

morally wrong Najib

Najib bang CUEPACS saying "its morally wrong" to demand for bonus. By reading utusan meloya, my understanding was the economy in a good shape then why it's morally wrong to demand? If demanding bonus is morally wrong then how about his image as Altantuya boyfriend. She was killed in terrorist way and the whole world know who is behind the murder. Sir don't you think it's morally wrong for you to run the country?

Sorry I'm not Fool

Muhyiddin said we are equal under the sun while Najib deny umno is a racist party. What a joke from this racist party leaders. Umno policy was race, religion and nation (bangsa, agama, negara) then was changed to religion, race and nation (agama, bangsa dan negara) due to the rise of PAS influence. At certain extend umno has became more extremist and racist compared to PAS. After 2008 political tsunami umno was seen begging the voters that they are not the racist party. At the same time for non-malays umno was seen preaching all malaysian is equal and the latest was muhyiddin statement. While universal human rights declaration clear said, all human beings is equal umno was in denial until the voters decided to deny their political ground. If what Muhyiddin and Najib was seen preaching to win the heart and mind of the voters is true then they must give equal opportunity to all the deserving Malaysian.

In-fact we need 1uitm, 1mrsm, 1 entry sistem to university, 1policy etc not sweet slogan 1Malaysia only. Sorry I'm not Fool.

Spectator video captures SL Police, SLA kill mentally ill Tamil youth

[TamilNet, Saturday, 31 October 2009, 12:37 GMT]

Sri Lanka Police and Sri Lanka Army soldiers beat a mentally ill Tamil youth and forced the youth to drown near the sea near Bambalapitya, Colombo, railway station Thursday. The youth was identified as Balavarnam Sivakumar, 26, of Ratmalana, according to media reports in Colombo, which belatedly listed the youth's identity. "The entire country [Sri Lanka] watched in horror, as a group of heavily built men attacked the mentally unstable [Tamil] youth with wooden poles while he pleaded for mercy, when it was telecast on several news bulletins on Thursday night," Daily Mirror said.
Police spokesman Nimal Mediwake said the Police and Army personnel who had allegedly assaulted the youth had been identified and would be arrested.

The youth has had mental depression for nearly two years and had received medical treatment in a mental hospital, Sivakumar's brother told the media.

Sivakumar had the habit of throwing stones at vehicles, and the Thursday killing followed a series of incidents involving similar actions by Sivakumar, according to the media.

A video broadcast by Channel-4 allegedly showing Sri Lanka Army (SLA) soldiers extra-judicially executing Tamil captives stripped naked and hands tied behind their back, has drawn worldwide attention, and independent forensic analyses in UK and USA are ongoing to rebut Colombo's cavaliar dismissal of the video as fake, according to reports. Two editors of Sunday Leader have received death threats for covering developing stories on the Channel-4 video.
